從米高鮑威爾到香港電訊政策

From a look at Michael Powell's resignation from the U.S. FCC to the regulatory policy regime in Hong Kong, it seems Hong Kong has been successful at where the U.S. has been failing.


從米高鮑威爾到香港電訊政策

  美國聯邦通訊局(FCC)主席米高鮑威爾,亦即美國國務卿鮑威爾的兒子,在本月22日宣布辭職,繼乃父之後,黯然離開華盛頓;米高在其向總統布殊遞交的辭職信中,雖然表示任內施行法例有助推動創新科技及增加市民的選擇,但亦坦言他的心情,「同時帶?驕傲與惋惜」,實有未竟全功的感慨。

  鮑威爾出身法律界,1997年由總統克林頓委任進入FCC,在2001年續得布殊委任為主席,成為全國電訊及廣播的最高監管及執法者。雖然他鼓勵推廣新的數碼技術,但他所推行的寬頻電訊政策,往往卻支持各不同技術平台各自提供綑綁式的套餐服務,與他的前任主席,要市場主導者以政府釐定價格開放給對手接駁互連,取態明顯不同。
美國電訊政策的制肘

  例如,米高鮑威爾把有線電視網絡上的寬頻服務界定為資訊而非電訊服務,免其受到對電訊服務較嚴厲的監管,也令有線電視商毋須為互聯網供應商提供線路接駁,這當然令電訊商、互聯網供應商及消費者組織大為不滿,其控告政府的官司尚在最高法院審理之中。不過,米高鮑威爾後來亦給予本土電訊商類似以上給予有線電視商的優待政策,再加上他主張的政策,亦曾在五名委員的FCC內達不到大多數,總之,惹來不少指其政策搖擺不定的批評。

  雖然米高鮑威爾努力推動寬頻服務的普及,包括互聯網電話等,但滲透率依然比其他國家如英國落後,更不要說亞洲的南韓等國家了,在數目上更可能快被發展中的中國追過;加上美國在流動電話應用方面,不論用戶人數至數據應用,更明顯落後;總之,在數量比較方面,美國表現實差強人意。

  所以,難怪美國各大報章在評論他的功過時,大多帶點可惜的感嘆,認為他未能成功引進競爭,政策方向亦不連貫,以至有些服務如流動電話的價格就下降了,但有線電視收費卻上升了三倍,《三藩市紀事報》就說:「國家要創新,但也要穩定可行的引導才成。」《洛杉磯時報》則指米高鮑威爾雖已盡力而為,但卻從得不到總統和國會的合作和支持。在1996年通過的電訊開放法例,剛落地已過時,但國會至今仍處於各方利益拉鋸之間,近十年已過,法例依舊,只叫監管者如無米的巧婦。

  如果說美國的電訊監管有點令人失望,相比之下,香港雖然只是一個較小、沒那?複雜和政治化的市場,但有些香港的監管者堅守的原則,的確令我們的電訊市場發展,以及消費者利益的保護,都做得比較好。首先,香港電訊管理局三代的領導,由艾維朗至王錫基到現在區文浩,開放市場政策基本穩定一致,技術中立原則亦不變,雖然市場環境就?競爭當然會轉變,但監管者的介入甚少,難怪在區內電訊業監管者中評價一向很高。

政策因時度勢

  不過,隨?開放市場的不同階段,業界一些聲音指開放政策把利益傾斜向消費者方面,當局政策對此也有合理地作出調整及平衡,例如去年撤銷對本地固定線路電訊服務的強制性第二類互連及撤銷香港電話零售價格須事先批准的規定,逐步採取事後規管模式,亦反映政策執行考慮到市場變化,在消費者利益達到後,特意保障主要電訊商對本地基建長遠性繼續投資的意欲;另一方面,以一貫開放態度對待新技術應用如互聯網電話,就令香港市場能繼續創新。

  未來監管面對的挑戰,除了在日新月異的電訊市場外,還有因為數碼21政策下電訊及廣播監管架構將會統一;筆者完全認同及支持這方向,但其帶來的更複雜問題卻不可忽視,始終內容監管總是不討好的。

  在美國,FCC也是同時監管電訊及廣播的,而各界對米高鮑威爾的臨別評語中,他最為人詬病和令人負面印象最深刻的,反而是他高調處理一些「不良內容」的手法,這也是值得香港決策者參考的。

裴氏研究成「預測」紀錄

A summary of the recent survey by the Pew Internet and American Life Project. It would be nice if there's such a project to look at the impact of the Internet and indeed telecommunications on Asia and China. If only there's a Pew foundation here :)


裴氏研究成「預測」紀錄
眾專家皆擔心互聯網被恐怖襲擊

  美國互聯網研究機構「裴氏互聯網及美國生活計劃」,剛推出了一個名叫「互聯網未來」的調查報告,調查以電郵發出問卷進行,機構先向一群技術專家及社會評論家發出問卷,再請他們把問卷轉發給他們認為有見之士,結果,調查以問卷訪問了一千二百八十六人,其中一半早在1993年前已使用互聯網,三分之一在學術機構工作,三分之一來自商界,其他就屬於非牟利機構、政府及傳媒等。

  調查所得結果中,最受各界關注的,是三分之二受訪者都認為於十年之內,互聯網的基礎設施或美國的電力網絡,將遭受嚴重的襲擊,無可否認,愈來愈複雜的網絡,和各方面對網絡的倚賴,令它成為恐怖分子難以抗拒的目標。

  專家亦同意,互聯網必定進一步融入各項環境設施,高速寬頻將更普遍,用戶數目也必大幅增長,從而對人們工作、生活、關係,都會帶來很多改變,例如超過 50%受訪者都認為虛擬課室及遠程工作等,都會更加普及。不過,有點令人擔心的,是近60%受訪者都認為政府和企業對個人的監察,亦將隨科技發展而更為無處不在。

宗教最不受互聯網影響

  不過,在互聯網的公民社會發展中角色問題上,受訪專家中就有較明顯的分歧,例如,互聯網會否令宗教和政治的極端主義抬頭,能否令人民社會網絡擴張,又或者科技能否解決醫療系統面對的成本和失誤等問題,專家們都沒有一致的信心,甚至,在具體的問題上,如網上投票選舉能否在十年後成熟、可靠和普及?只有不足三分之一的受訪者對此預測認同。

  互聯網所引發的變化,專家認為對各傳統機構或行業,尤其新聞、出版、教育、醫療等方面將非常顯著,例如近年大紅大紫的博客(blog)、點對點網絡上的影音擋案交換等,對傳統新聞工作、內容創作及發行的模式,明顯將有翻天覆地的改變。不過,專家認為,互聯網對傳統社區和家庭,以及政治組織的影響反而有限;至於最「不為所動」的,竟然是宗教。

  網絡技術與資訊運用的相輔相成,包括一些令部分企業及政府執法者相當頭痛的問題,如點對點網絡上的盜版內容,對很多專家反而是個令人鼓舞的創新,反而一些以為應最易受惠於科技得以改善的範圍,卻對改變最抗拒,其中最令人失望的,莫過於教育界,也許這完全不叫人意外,我們只要看看近日香港教師為求利益的工業行動就明白,這些不市場化的利益團體的問題,中外都大致相同。

科技與社會文化互動

  無論如何,裴氏互聯網研究已成為資訊及通訊科技發展中一個非常有趣的「預測歷史」紀錄項目,從1990年起,專家對未來的預測,對也好,錯也好,這些預測都反映了人們在當時對未來的期望,這些資料本身也是個思想的歷史紀錄。

  對我們科技界人來說,這些研究的價值,亦包括提醒我們不能夠只講技術、產業、市場這些,科技與文化、民生和社會的互動關係,也是「持續發展」的一部分,亦不可忽視。

Hong Kong IT Industry Responded Immediately to the "IT Cares for Tsunami Relief Campaign"

Industry Responded Immediately to the “IT Cares for Tsunami Relief Campaign”

[Hong Kong, 7 January, 2005] –“IT Cares for Tsunami Relief Campaign” organized by the initiating organizations of “IT Matters for Hong Kong” gained immediate response from the IT industry. An appeal letter was sent to the IT sector on 31 December, 2004, urging them to provide monetary and technical assistance to their preferred charitable organizations that are helping the Tsunami victims, and within a few hours, we received considerable number of emails and phone calls from the IT sector, volunteering to offer their helping hands. We are happy to announce that 6 laptop computers were raised in the initial stage and sent to Indonesia to assist the emergency medical work of Médecins Sans Frontières (MSF).

We received an urgent request from MSF on 4 January, 2005, as they require 6 laptop computers for their emergency mission in Indonesia. HP Hong Kong reacted immediately and agreed to sponsor 6 laptop computers to the organization while Microsoft Hong Kong Limited sponsored 6 copies of Microsoft Office 2003 Professional Edition. The computers were set up in the evening of 5 January, 2005, by volunteers from HP Hong Kong, and picked up by representatives from MSF late that evening, then brought to Indonesia by their field volunteers early in the morning on 6 January, 2005.

“MSF is very thankful to the quick response from the IT industry in Hong Kong on their joint effort to facilitate our emergency relief work in Indonesia. This certainly helps our teams deliver assistance to the most needy in a more efficient manner,” said Mr Dick van der Tak, Executive Director of MSF Hong Kong.

MSF has started medical intervention in Indonesia, Sri Lanka and India for the earthquake and tsunami victims. In Indonesia, MSF teams are working in the worst hit Aceh. The donated computers will be used by our teams in Indonesia to coordinate the relief work and facilitate the internal as well as the external communication.

“We would like to thank HP and Microsoft for their generosity and quick response to this urgent request. We would also like to thank everyone in the IT sector who contributed ideas as to how we can help in terms of IT assistance, and those who provided monetary donations. We are glad to have the IT sector join hands to help in this tragic event,” says Mr. Charles Mok, spokesperson of “IT Matters for Hong Kong”

Mr. Mok continues, “As IT professionals or companies, if you or your organization can offer IT capabilities to assist in the search of missing persons, to help friends and relatives of victims or missing persons to find their loved ones, or any other technical support you can offer to parties involved in the aid effort, please let us know and we would do our best make arrangements so that your help can benefit the people in need.”

災後重建資科界八方支援

  2004年12月26日,印尼大地震及其引發的世紀大海嘯,令全球人民震驚之餘,亦同時帶出了人類互助精神的善良一面,資訊科技界也盡了一分綿力。

  早前以「資訊科技與香港的發展—息息相關」活動已開始合作的香港四個主要資訊科技界的商會及專業學會(香港電腦學會、香港資訊科技商會、資訊及軟件業商會及香港無線科技商會),在除夕起向會員發出「IT Cares」呼籲捐款賑災,並得到多個業內友會支持。本來,我們考慮過特設一個捐款戶口,但救災實屬分秒必爭,為了方便捐款人士自己選擇接受資助的救援機構,我們只集中提供國際救援機構的戶口資料和熱線。

藉手機短訊捐款

 另一方面,「IT Cares」向業界呼籲,如果能以行業的資源及專業能力,為救援工作提供有效和實質幫助的,我們也歡迎提出建議;數天之內,有企業承諾可為有需要的救援機構甚至政府提供免費服務,例如有傳呼中心願意免費提供熱線,也有流動通訊商及互聯網供應商向用戶發出短訊或電郵呼籲。

  據報道,在不少國家中,流動電話和短訊為善長仁翁提供了一個最方便的捐款方法;例如,意大利四家流動電話公司和電視台聯合設立了一個捐款特別賬戶,用戶每向指定號碼發送一個短訊,就代表捐出一歐羅,這樣就收到一千三百萬歐羅;類似的方法,在德國已有超過一百萬人參加,捐出了近三百萬歐羅,在葡萄牙也就在線路開通的首天已經收到了逾二百萬歐羅;在西班牙、法國、芬蘭、新加坡等國的電訊商,也發動了同類的募捐。

  在互聯網上,很多入門網站都提供了捐款資料,其中網上零售商亞瑪遜利用其「一按式」的付費系統,至周日晚已收到超過一千二百萬美元捐款。

  不過,被海嘯沖毀了無數基本電訊設施的地區,恢復對外通訊十分重要,一個名為NetHope的業界與救援組織的聯盟,已開始為這項工作提供協調;思科系統將為災區提供NetRelief組件,以最簡便方式利用Inmarsat的衛星對外接駁,本地就以無線區域網連接,為救援隊伍的統籌管理工作提供必需的通訊;一些企業如IBM更已派遣其危機應變隊到印度、斯里蘭卡及泰國等地。一些草根的自發性人士,也開始籌集急需的網絡和無線電器材和志願人士,分配為災區服務,例如美國南加州的Post-Tsunami Reconnect。

需系統及器材的捐助

  透過業內的國際網絡,我們收到了印尼資訊科技商會及印尼互聯網供應商協會的匯報及呼籲,表示在得到多國機構及人士支持下,受災最嚴重的亞齊省成功啟動了第一個資訊科技及媒體中心,已有六位專家到了當地重建通訊,為其他救災及醫護人員的工作和統籌提供基礎;目前,印尼業界正要求一系列系統和器材的捐助,包括筆記簿電腦、全球定位儀器、衛星電話、電纜、發電機、無線區域網接駁點等,以及衛星通訊商提供更多的頻寬,因為他們希望在亞齊省內,至少建立多五個資訊科技及媒體中心。
